Description: <DIV STYLE="text-align:Left;"><DIV><DIV>Truckee Carson Irrigation District (TCID) water rights are the remaining water after all the Delta’s (changes) have occurred. Water rights include vested (pre-contract), contract, permit, retirement and farm units. A Pre-Contract or an original Contract, Permit, or Farm Unit grants a landowner a specific amount of water to irrigate their land.When all the Water-Right changes have been made and the regenerate tool has regenerated all the polygons, the resultant acreage will show the remaining acreage for the contract or permit. Points of Diversion: The POD’s used to irrigate the water righted land are Lahontan Dam or Derby Dam.Places of Use: The application map is georeferenced to obtain the POU boundary. County parcel maps are also used to trace boundaries of water use for farm units. Water Rights were given four different kinds of names by the mapping team.<OL STYLE="margin:0 0 0 0;padding:0 0 0 0;"><LI>Vested rights were identified by the numbers given to the farmers to name their water usage for farming production prior to July 2nd, 1902. By adding a ‘V’to their numbers (Example 01069.0.v), the mapping team was able to identify which Water Rights were established before contracts. We call the vested water rights ‘Pre-Contract’water rights, meaning they were established before contracts came into effect. </LI><LI>Contract numbers were issued by the Bureau of Reclamation (BOR) after July 2nd, 1902 and prior to 1926. Our team has added a P (for prior) before the number that the BOR assigned (Example P311.0) to set them apart from the contracts issued after 1926 by Truckee Carson Irrigation District (TCID) (Example311.1).</LI><LI>Permit numbers were issued by Nevada Department of Water Resources (NDWR) starting in 1984. </LI><LI>Farm Units were established in DATEand given the same number as a change permit by NDWR.</LI></OL>Assembly Bill No. 415–Committee on NaturalResources, Agriculture, and MiningCHAPTER..........AN ACT relating to water; revising provisions relating to the use ofwater on certain lands in a federal reclamation project; andproviding other matters properly relating thereto.Legislative Counsel’s Digest:Under existing law, a water right is generally considered to be appurtenant to,or belong to, the land where it is used. Existing law provides that a surface waterright acquired by a water user in a federal reclamation project is considered undercertain circumstances to be appurtenant to an entire farm rather than particular landwithin the farm. In this context, a “farm” is defined to be a tract of land that isunder the same ownership and primarily used for agricultural purposes. (NRS533.040) This bill revises the definition to include two or more tracts of land thatare owned or leased by the same person and are primarily used for agriculturalpurposes, regardless of whether the tracts are contiguous to one another.EXPLANATION – Matter in bolded italics is new; matter between brackets [omitted material] is material to be omitted.THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED INSENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:Section 1. NRS 533.040 is hereby amended to read as follows:533.040 1. Except as otherwise provided in this section, anywater used in this State for beneficial purposes shall be deemed toremain appurtenant to the place of use.2. If at any time it is impracticable to use water beneficially oreconomically at the place to which it is appurtenant, the right maybe severed from the place of use and be simultaneously transferredand become appurtenant to another place of use, in the mannerprovided in this chapter, without losing priority of right.3. The provisions of this section do not apply to a ditch orcanal company that appropriates water for diversion andtransmission to the lands of private persons for an annual charge.4. For the purposes of this section, a surface water rightacquired by a water user in a federal reclamation project may beconsidered appurtenant to an entire farm, instead of specificallyidentifiable land within that farm, upon the granting of a permit forthe change of place of use by the State Engineer which designatesthe place of use as the entire farm. The quantity of water availablefor use on that farm must not exceed the total amount determined byapplicable decrees as designated in the permit granted by the StateEngineer.5. For the purposes of this section, a water right acquired forwatering livestock by a person who owns, leases or otherwisepossesses a legal or proprietary interest in the livestock beingwatered is appurtenant to:(a) The land on which the livestock is watered if the land isowned by the person who possesses a legal or proprietary interest inthe livestock; or(b) Other land which is located in this State, is benefited by thelivestock being watered and is capable of being used in conjunctionwith the livestock operation of the person who owns the land if thatland is owned by the person who possesses the legal or proprietaryinterest in the livestock being watered.6. The provisions of subsection 5 must not be construed:(a) To impair a vested right or other existing water rightestablished before June 12, 2003, of a person to the use of water forthe purpose of watering livestock; or(b) To prevent any transfer of ownership of a water right for thepurpose of watering livestock.7. As used in this section, “farm” means a tract of land [underthe same ownership] that is owned or leased by the same personand is primarily used for agricultural purposes. The term includestwo or more such tracts of land, regardless of whether the tractsare contiguous to one another.</DIV></DIV></DIV>
